Please read these Terms of Service (“Terms”, “Agreement”) carefully before installing, accessing, or using the Blink Chrome browser extension (“Extension”, “Service”) operated by Blink Pay Inc. (“Company”, “we”, “us”, or “our”).

By installing, enabling, or using the Extension, you (“User”, “you”) agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Extension, and uninstall it immediately.

1. Acceptance & Eligibility

By downloading or using the Extension from the Google Chrome Web Store, you represent and warrant that:

  • You have reached the age of majority in your Canadian province or territory of residence, or have obtained explicit consent from a parent or legal guardian if you are between 13 and the age of majority.
  • If you are using the Extension on behalf of a corporate entity, organization, or business registered in Canada, you possess the legal authority to bind such entity to these Terms.
  • Your use of the Extension complies with all applicable Canadian federal, provincial, territorial, and local laws and regulations.

2. License Grant & Scope

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the Extension solely for your personal or internal business purposes on devices owned or controlled by you, in accordance with the Google Chrome Web Store Terms of Service.

3. Prohibited Conduct & Restrictions

You agree not to, and will not permit any third party to:

  • Decompile, reverse engineer, disassemble, or attempt to derive the source code of the Extension, except to the extent such restriction is expressly prohibited by applicable Canadian law;
  • Modify, adapt, translate, or create derivative works based upon the Extension;
  • Rent, lease, lend, sell, redistribute, sublicense, or commercially exploit the Extension;
  • Bypass, disable, or circumvent any security measures, digital rights management (DRM), or access controls integrated into the Extension;
  • Disrupt server infrastructure or network connectivity of the Company or any third-party service;
  • Use the Extension for any illegal, unauthorized, or fraudulent purpose under Canadian law, or in violation of Google Chrome Web Store Developer Policies.

4. Privacy & Data Protection (PIPEDA & Canadian Law)

Your privacy is governed by Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy statutes (e.g., in BC, Alberta, or Quebec). Our data collection, storage, and handling practices are detailed in our Privacy Policy located at https://www.thankyoublink.com/privacy

The Extension requests technical permissions required for operation (e.g., active tab access, local storage). By installing the Extension, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy and manifest file.

5. Intellectual Property Rights

The Extension, including all software code, visual design, user interfaces, trademarks, trade names, and branding, is owned by the Company and protected under the Copyright Act (Canada) and international intellectual property treaties. No title or ownership rights are transferred to you.

6. Third-Party Services

If the Extension enables interactions with third-party websites, APIs, or services, you acknowledge that the Company does not control or endorse such services. Your interactions with third parties are governed strictly by their respective terms and privacy policies.

7. Updates & Modifications

We may automatically deploy updates, security patches, or bug fixes via the Google Chrome Web Store. You consent to such automated updates. We reserve the right to modify, suspend, or discontinue features of the Extension at any time.

8. Term & Termination

These Terms remain effective until terminated. You may terminate at any time by uninstalling the Extension. The Company may terminate your license immediately without notice if you breach these Terms.

9. Disclaimers & Statutory Consumer Rights

THE EXTENSION IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, THE COMPANY DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Note for Canadian Consumers: Certain provincial consumer protection legislation (such as Ontario's Consumer Protection Act or Quebec's Consumer Protection Act) does not allow limitations on implied warranties or statutory conditions. If these laws apply to you, some or all of the above limitations may not apply.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE EXTENSION.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU FOR THE EXTENSION IN THE PRIOR 12 MONTHS OR UP TO $20.00 CAD, WHICHEVER IS GREATER.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the federal laws of Canada and the provincial laws of British Columbia, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in Vancouver, British Columbia.

12. Language Clause (Language Requirements)

The parties acknowledge that they have required these Terms and all related documents to be drawn up in English. Les parties reconnaissent avoir exigé que la présente convention et tous les documents connexes soient rédigés en anglais. (If offering this Extension to residents in Quebec, ensure compliance with the Charter of the French Language as applicable).

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated versions will be posted on our website at thankyoublink.com/terms-of-service with an updated “Effective Date”. Your continued use of the Extension after changes are posted constitutes acceptance.
